The key man behind Shanghai's ambitious plan to develop the city into the world's leading financial centre by 2020 has been promoted to an elite economic team that may help the city speed up its market reforms as it prepares to take on Hong Kong.

Fang Xinghai, former head of the Shanghai Financial Services Office, who once famously downplayed Hong Kong's importance as a financial hub, has been named a senior official at the Office of the Central Leading Group for Financial and Economic Affairs, sources close to the leadership said.

The team worked for the central committee of the Communist Party and was in charge of all vital financial and macroeconomic matters, the sources said.

Premier Li Keqiang directly oversees this low-profile, Beijing-based group, whose main responsibilities include making and advising on key economic decisions and drafting the working agenda of the Central Economic Work Conference, the most important annual economic policy meeting in the country. While Fang's elevation signals the leadership's eagerness to draw younger local officials to Beijing's top policymaking circles, it may also make officials in Hong Kong uneasy.

At the 2011 Asian Financial Forum in Hong Kong, Fang said the speed with which Hong Kong became a successful offshore yuan centre would depend on how soon Shanghai could turn itself into an onshore yuan trading centre. The statement, signalling a subordinate role for Hong Kong in the future, triggered concerns among Hong Kong officials and bankers.

One of the sources, who spoke on condition of anonymity, said Fang wrote a letter to President Xi Jinping during the National People's Congress meeting this year to express his interest to "serve the country's financial industry development better at the national level", and Xi quickly forwarded it to the central group in charge of financial and economic affairs.

Fang and Xi briefly worked together in Shanghai when Xi was appointed the city's party chief in 2007.

Fang landed the promotion soon after.

Han Zheng , Shanghai's party chief, supported the promotion and hosted a small farewell dinner for Fang.

"At the farewell dinner, Han praised Fang's achievements during his time in Shanghai and asked him to continue to support the city's financial development in his new role," said one of the sources.

Fang, who obtained his PhD in economics from Stanford University, took the helm of the Shanghai Financial Services Office in 2007 and has been deputy general manager of the Shanghai Stock Exchange.

The Shanghai Financial Services Office declined to comment on Fang's promotion.

In 1998, when he had just turned 30, he was invited by Zhou Xiaochuan , then head of China Construction Bank, to return to China.

At that time he was in the US, where he worked for several organisations, including the World Bank after graduation.

Despite Fang's personal ties with powerful officials and bankers in Beijing, including Zhou, now the central bank governor, he has had his share of brushes with red tape in trying to push forward his various initiatives.

His new role could save him the trouble of clearing bureaucratic hurdles at every step and allow him to get his views and plans across to the top echelons more easily.

The Microsoft trial was called the most important antitrust case before a U.S. court since the Standard Oil breakup of 1911. Beefy and six feet tall, Judge Jackson spoke in a deep, booming baritone and was a commanding courtroom presence. Observers noted that the judge quickly grasped the complex technical issues of the Microsoft case, but as the trial dragged on, his impatience became palpable.

Reporters noted that Judge Jackson rolled his eyes or scowled at statements by Microsoft’s attorneys and laughed during videotaped testimony by company co-founder Bill Gates. At other times during the proceedings, he appeared to yawn or nod off.

Judge Jackson issued his decision in April 2000, decreeing that Microsoft should be separated into two companies. Soon afterward, he stirred even greater controversy with a series of interviews in which he compared the computer software giant to a street gang and described Gates as “Napoleonic.”

It was rare — even unheard of — for a sitting judge to discuss his cases in such an unvarnished manner.

In reviewing Judge Jackson’s decision in 2001, a federal appeals court overturned his order that Microsoft should be broken up, but it sustained his primary ruling that the company acted as a monopoly.

But the appeals court wasn’t done. After addressing the legal issues, the judges issued a startling and sharply worded rebuke of Judge Jackson’s behavior in the case, charging him with “egregious” violations of judicial ethical standards.

Google on Wednesday downplayed its role in a secret government surveillance program, detailing for the first time how it typically hands over data to federal officials.

When faced with a court order, the tech giant said, it uses surprisingly simple and low-tech methods, including the delivery of information by hand or by using relatively common techniques to transfer files from one computer to another.

“When required to comply with these requests, we deliver that information to the U.S. government — generally through secure FTP transfers and in person,” Google said in a statement.

That could include putting data onto a memory disk or external hard drive, or printing out the requested information for a federal official, Google said. FTP, or file transfer protocol, is a popular method for exchanging information between servers with an extra layer of security.

The company’s disclosure of how it handles National Security Agency requests might skirt its obligations to keep data requests secret, experts said. So far in public, the company has fiercely maintained that it has never heard of a secret NSA Internet surveillance program called PRISM, first revealed last week by The Washington Post and the Guardian newspapers.

Those outlets reported on an NSA document that showed the agency has been tapping directly into the servers of nine major U.S. Internet companies in order to track foreign terrorism suspects.

Immediately after PRISM was publicly reported, Google, Facebook, Yahoo, Microsoft and others denied giving the government “direct access” to their servers.

Since then, The Post has reported that executives at some of the participating Silicon Valley companies, who spoke on the condition of anonymity, have acknowledged the program’s existence. According to a NSA inspector general’s report obtained by The Post, PRISM allowed “collection managers [to send] content tasking instructions directly to equipment installed at company-controlled locations” rather than directly to company servers.

Cybersecurity experts said the news reports put Google and other tech companies in a difficult position because they might not be able to discuss dealings with the NSA.

“I think that the tech companies want to assure the American people that they are playing a role blocking excessive demands for their information,” said Susan Freiwald, a professor of cyber-law and information privacy at the University of San Francisco.

Google, Facebook, Microsoft and Yahoo this week called for the Justice Department to remove gag orders that prevent them from discussing orders under the Foreign Intelligence Surveillance Act. They fear that the secrecy of their involvement in government surveillance requests leads the public to imagine the worst, said Freiwald.

Revelations about Google’s participation are particularly bruising for a firm that has been touted for protecting users’ data.

On Wednesday, Google elaborated on what it is not allowing the government to do.

It says it does not allow the NSA to collect information through a secure portal nor does it put information into a “drop box” for government agents to access. It said it has a team of employees who review every FISA order.

“The US government does not have the ability to pull that data directly from our servers or network,” the Google statement said.

Some technology law experts scoffed at Google’s claims of delivering information by hand. While the government seems to employ various ways of obtaining data, it appears to seek a large amount of information in a format that is searchable, which suggests that its collection from Google, Facebook and others is vast, these experts said.

Officials and former staffers at the tech companies said it would be difficult for the government to place equipment on their servers or directly access them in secret. Too many engineers would know, they say.

“There is obviously a big disconnect between how the NSA is marketing this capability internally and how different companies respond,” said Alan Davidson, a former director of public policy at Google. “Less secrecy would help everyone.”

The Food and Drug Administration is tightening standards for a wide range of medical devices-from fetal monitors used in hospitals to pacemakers implanted in people-because of escalating concerns that the gadgets are vulnerable to cybersecurity breaches that could harm patiens.

Increasingly, officials said,computer viruses and other malware are infecting equipment such as hospital computers used to view X-rays and CT scans as well as devices in cardiac catheterization labs.The security breaches cause the equipment to slow down or shut off entirely, complicating patient care. As more devices operate on computer systems that are connected to each other, the hospital network and the Internet, the potential for problems rises dramatically, they said.

“Over the last year, we’ve seen an uptick that has increased our concern,” said William Maisel, deputy director of science and chief scientist at the FDA’s Center for Devices and Radiological Health. “The type and breadth of incidents has increased.” He said officials used to hear about problems only once or twice a year, but “now we’re hearing about them weekly or monthly.”

The FDA, in an effort to reduce the risks, for the first time is directing device manufacturers to explicitly spell out how they will address cybersecurity. On Thursday, the agency issued draft guidelines that, when finalized later this year, will allow the agency to block approval of devices if manufacturers don’t provide adequate plans for protecting the gadgets and updating their security protections over their commercial lifetimes. The FDA is also issuing a safety communication to manufacturers and hospitals.

The Department of Homeland Security, which is working with the FDA to reduce these vulnerabilities, recently received reports from two researchers that found potential weaknesses in 300 medical devices produced by about 50 vendors, an official said. The department also is planning to release an advisory on medical devices Thursday.

FDA, facing cybersecurity threats
Government officials and patient safety advocates say they do not know of any cases in which patients have been directly injured because of a device compromised by a computer virus. And there is no evidence any implantable devices have been corrupted by viruses or other malware. Nor is there evidence that hackers have deliberately targeted a hospital network or medical device for malicious cyberattacks.

Still, experts say, hospitals and device manufacturers need to use multiple defenses to guard against the threats posed by the Internet.

“There’s almost no medical device that doesn’t have a network jack on the back,” said John Halamka, chief information officer at Beth Israel Deaconess Medical Center in Boston. “To fight the evils of the Internet, not only do you have to have a moat, you have to have a drawbridge, burning oil to pour on attackers, and guys with arrows.”

Hospitals use thousands of medical devices, including ventilators that help patients breathe, monitors that measure a patient’s vital signs, and pumps that deliver medicine. Implantable devices include pacemakers, insulin pumps and defibrillators, many of which can be remotely monitored through a wireless network, making them susceptible to hacking.

In 1971, an American military analyst named Daniel Ellsberg gave a New York Times reporter a copy of “United States – Vietnam Relations, 1945–1967: A Study Prepared by the Department of Defense,” a multi-volume work that became known as the Pentagon Papers. U.S., Germany, Italy commit to training roles in post-2014 Afghanistan

The United States has agreed to lead a training mission in Afghanistan after 2014 that will include troops from Germany and Italy and will operate under a new NATO mandate, officials announced Wednesday.

U.S. troops would be based in hubs in the east and south, Taliban strongholds where the Afghan army is likely to face a deadly insurgency for years to come. Germany has pledged to keep troops in the north and Italy in the west, an arrangement that would mark a continuation of the current force structure, albeit with far fewer troops.

Officials did not specify how many troops the mission, called Resolute Support, would include. They declined to say whether it would include a counterterrorism mission, one of the capabilities the Obama administration has expressed interest in keeping after the mandate of NATO’s current troop contingent, the International Security Assistance Force, expires.

“The new mission will not be ISAF by another name,” NATO Secretary General Anders Fogh Rasmussen said. “It will be significantly smaller.”

Rasmussen said Turkey is considering keeping troops in Kabul but has not made a definitive pledge. There was no mention of a role for British troops, which have been the second-largest troop contributor of the war.

The White House has been reluctant to specify how many troops it would be willing to keep in the country because it has yet to sign a security cooperation agreement with Afghan President Hamid Karzai. That has made U.S. allies reluctant to make their own commitments to keep on pouring money and troops into a deeply unpopular conflict.

After meeting with his counterparts from allied nations at NATO, Secretary of Defense Chuck Hagel told reporters that the United States has an “unwavering commitment to the future of Afghanistan.”

“We’re transitioning, not leaving,” Hagel said.

The NATO chief said international trainers would advise only at the highest levels, no longer at the brigade and battalion level. That suggested Afghanistan’s fledgling army will do without the critical capabilities the international community has provided, including the ability to carry out aerial medical evacuations.

U.S. military officials say the Afghan army is unmistakably in the lead, taking heavy casualties. In a recent two-week period, more than 200 Afghan forces were killed in fighting, the top commander of NATO troops in Afghanistan, Gen. Joseph Dunford, said this week. Despite the bloodshed, NATO officials say it is time to shift the burden.

“Ultimately, it is for the Afghans to determine their own future,” Rasmussen said. “That is what transition is all about.”

Rasmussen and Hagel said international support for Afghanistan after 2014 is contingent on responsible behavior by the government in Kabul, a clear message to Karzai, who has been a prickly and often unpredictable ally.

“Commitment is a two-way street,” Rasmussen said. “We also expect the Afghan government to live up to its obligations, including full respect for basic democratic principles and human rights.”

Hagel said a “free and fair election” in Afghanistan would be an “essential part of any future commitment.”
